Criminal Justice Bill Alerts

The following are bills related to Criminal Justice in Arizona.  They are out of committee so it is not possible to use the RTS system.  Contact your Senators about these bills this week.

HB 2055 – SUPPORT – Expands situations where a person may apply to the juvenile court to set aside a delinquency or incorrigibility adjudication or to seek the destruction of juvenile records.

HB 2424 – SUPPORT – Requires that an undesignated felony be treated as a misdemeanor for all purposes until the court designates the offense a felony.

SB 1334 – SUPPORT – Prohibits a court from sentencing a defendant as a repetitive offender unless the defendant was convicted and sentenced for a historical prior felony before the person committed the present offense.

HB 2080 – SUPPORT – Automatic restoration of rights for first time offenders if victim restitution is paid.  Doesn’t include gun rights.

HB 2570 – SUPPORT – Study for missing and murdered indigenous women.

HB 2602 – SUPPORT – Sentences MAY run consecutive or concurrent as determined by the court. 

SB 1250 – SUPPORT – Sexual assault victim can get an injunction against harassment against the abuser.   Doesn’t require new order of protection.

SB 1485SUPPORT – Bill would end the 20% annual automatic growth of corporate private school tax credits by gradually decreasing the cap to 2% or inflation over the next 5 years. S  

SB 1230 – Support — appropriates $5 million to fund special education grants for public schools.

SB 1099 – SUPPORT – Bill would prohibit schools from denying access to “patriotic” groups who wish to speak for limited periods in a public school.  “Patriotic” groups include Big Brothers-Big Sisters, Boys and Girls Clubs, Girl Scouts of the USA, Little League Baseball, etc.

SB 1149 – Oppose – striker to allow discriminatory admission policies for districts.     

SB 1023 – Oppose – undermines Arizona’s citizen initiative process

SB 2005 — Oppose — requires ballot measures to collect signatures in all districts.

HB 2026 – OPPOSE – Bill prohibits teachers from speaking out or protesting in other ways about legislations or elections.

HB 2032OPPOSE – Bill further prohibits teachers from using speech or curricula during school time to influencing or changing a students political ideology or religious belief.


Other Important Bills, including voter suppression bills

SB 1291 – OPPOSE – Incredibly this bill would legalize nunchuku, a traditional martial art weapon.  Who needs a new killer weapon?

HB 2724 – OPPOSE – This bill is a direct attach on the Arizona Clean Elections Board by making any rule developed eligible to be challenged by anyone – resolution to be decided by the Governor’s Regulatory Review Council (GRRC) – guess we know how that will turn out.

SB 1451 – OPPOSE – This bill would make it almost impossible to get ballot initiatives onto the ballot by making the petition process very complex and difficult.

SB 1167 – OPPOSE – This bill would prevent those who choose to boycott Israel from getting government contracts.  Earlier attempts at bills like this have been declared unconstitutional.

HB 2616 – OPPOSE – Bill would prohibit payment by signature to individuals for registering voters and would require the voter registrations to be turned in within 10 days or the person doing the registering will go to jail!!

SB 1147 – OPPOSE – Bill allows anyone over 21 to use e-cigarettes anywhere on school campuses – further the bill prevents any local authority to restrict their use.

SB 1149 – OPPOSE – Bill would increase governing  board’s authority to deny enrollment to suspended students who are trying to transfer.  Many believe this would be used mainly against minority students.

SB 1161 – OPPOSE – Bill would require School Facilities Board to publish, yearly, a list of unused or partially used school spaces AND would require school districts to accept bids from charter schools for that space if the charter school was the LOWEST bidder.

SB 1173 – SUPPORT – Bill would continue to provide supplemental child care assistance to parents who go back to school to further their employment goals.

HB 2125 – SUPPORT – Bill would release Federal Funds to Arizona for Child Care – the amount is $56 million.

SB 1088 – SUPPORT – Bill would provide comprehensive dental coverage through Medicaid for pregnant women who are 21 or older.

SB 1353 – SUPPORT – Bill provides diabetes care for Arizona’s Medicaid recipients.

SB 1355 – SUPPORT – Bill provides dental care in the AHCCCS program for American Indians.

SB 1098 – SUPPORT – Bill will create a pilot program that will provide grants to help individuals transition from public assistance to more secure housing.

SB 1366 – OPPOSE – Bill provides expanded tax exemption for software used in data centers – retroactive to 2013.  Designed to lure large data center providers to Arizona while reducing the general fund.

HB 2616 – OPPOSE – Bill would prohibit payment by signature to individuals for registering voters and would require the voter registrations to be turned in within 10 days or the person doing the registering will go to jail!!

SB 1451 – OPPOSE – Bill would increase the amount of information required from those who circulate petitions and permits subpoenas, in case of a challenge, to be mailed to the committee, rather than the normal practice of mailing them to the actual individual.  If individual doesn’t show up in court as ordered all petitions collected by that person are thrown out.

HB 2724 – OPPOSE – This bill is a direct attach on the Arizona Clean Elections Board by making any rule developed eligible to be challenged by anyone – resolution to be decided by the Governor’s Regulatory Review Council (GRRC) – guess we know how that will turn out.

SB 1040 – SUPPORT – Bill would establish a committee to recommend improvements to information collection concerning the incidence and causes of maternal fatalities and severe maternal morbidity.

SB 1468 – SUPPORT – Bill would require suicide prevention training for all school personnel who work with students from grad 6 through 12.

SB 1485 – SUPPORT – Bill would end the 20% annual automatic growth of corporate private school tax credits by gradually decreasing the cap to 2% or inflation over the next 5 years.

SB 1188 OPPOSE – Bill would remove people from the Permanent Early Voting List (PEVL) if they don’t vote by early ballot, BY MAIL,  in the last two election cycles!!
