A. Seek Senate support for the Domestic Terrorism Prevention Act of 2022. The house
passed this bill on May 18 by a vote of 222 to 203. All Republicans voted against it. The
measure steps up the sharing of information about domestic terrorism among
government departments and creates an interagency task force to analyze and combat
white supremacists and neo-Nazi infiltration of the uniformed services and federal law
enforcement agencies. Call our Senators to support this act when it comes to the
Senate for review and approval.
B. Information to alert you to a new threat to our vision of government and Democracy
has to do with the “nondelegation doctrine” – something on a par with “replacement
theory” and something we need to be aware of. On May 18 the United States Court of
Appeals for the Fifth Court ruled that “Congress unconstitutionally delegated legislative
power to the SEC (Securities and Exchange Commission) by failing to provide an
intelligible principle by which the SEC would exercise the delegated power…” The Fifth
Circuit covers Louisiana, Texas and Mississippi, and its judges lean to the right. This
decision suggests that the potential overturning of Roe v. Wade has empowered other
judges to challenge other established precedents. The “nondelegation doctrine” implies
that Congress or the Legislative Branch of government cannot delegate authority to the
executive branch. Most of the regulatory bodies of the government since the New Deal
have been housed in the executive branch. The implication is that Republicans want to
totally hamstring the modern regulatory state and according to Justice Elena Kagan, the
nondelegation doctrine would mean that “most of the Government is
unconstitutional.”!!! Watch out for this new threat in Republican rhetoric.
C. Ask Tom O’Hallarhan to support the effort to secure a State Department and the FBI
to investigate the shooting of a US Citizen, Shireen Abu Akleh by Israeli forces on May 11
in Palestine. Ms. Abu Akleh, a 51-year-old journalist, was killed during suspicious
circumstances. Several House Representatives (Carson, Correa, and Pascrell) have sent
a letter to the State Department requesting an investigation to determine if Ms. Abu
Akleh’s rights were violated as an American Citizen and a Journalist. Journalists
worldwide need to be protected at all costs. The State Department called Ms. Abu
Akleh’s death “an affront to media freedom.” Ask our representative to support this
effort.
